James Britton cleared after appealing against convictions for sex assaults on girls

A man jailed for four years for sexually assaulting two girls has been now been acquitted and released.

James Britton successfully appealed against the convictions and at his retrial he was cleared of one of the charges and the jury could not reach a verdict on the other.

The prosecution told Judge Charles Macdonald QC at Maidstone Crown Court that no further evidence would be offered and a not guilty verdict was entered.

Britton, of Carroll Gardens, Larkfield, Maidstone, had been convicted of 13 offences of making indecent images of children at a separate trial and was sentenced to two months concurrent with the four years.

He was accused of assaulting the 16-year-old girls at parties at his home.

Prosecutor Robert De Banzie alleged Britton, 37, molested one of the girls after she fell asleep.

Heavy drinking was also involved at another party when the second girl was alleged to have been assaulted.

Mr De Banzie said about 500 indecent images were found on Britton’s computer after his arrest. Most were at the lowest level of one - “posting erotic activity by children”.

The images had been viewed as long ago as 2009 and were deleted.
