Isaiah Morgan and Silvio Ukaegbu stand trial for 'joint enterprise rape' of girl at party in Chatham

A teenager raped a “paralytic” sleeping girl in a bedroom at a party while his friend stood guard at the door, a court heard.

Because of the 17-year-old’s inebriated state, her friends had put her to bed at the house in Chatham.

She awoke to find 19-year-old Isaiah Morgan on top of her having sex with her, it was alleged at Maidstone Crown Court.

While it was happening Silvio Ukaegbu, also 19, stood by the door to prevent anybody entering, the jury of nine men and three women was told.

Morgan, of Livingstone Road, Gillingham, and Ukaegbu, of Chatham, deny “joint enterprise” rape.

“The Crown’s case is these two defendants came into the room while she was asleep,” said prosecutor Dominic Connolly.

“While asleep, and therefore she couldn’t consent, Mr Morgan had sexual intercourse with her.

“While he did so, Mr Ukaegbu guarded the door to warn his friend if anyone was coming, to prevent anyone coming in.”

The teenage girl had a lot to drink at the party. She remembered seeing Morgan and Ukaegbu. Morgan, she said, kept putting his hand on her backside and kissing her, so she moved away.

Mr Connolly said friends became concerned about how drunk she was as she was falling over, and decided to put her to bed.

While in the bedroom she could hear everybody else having fun and kept trying to join them. Every time she did so, friends put her back to bed.

“She was lying there dozing on her own when Mr Morgan came into the bedroom,” said Mr Connolly. “He didn’t say anything to her, but lay on her and pressed himself against her.

“He started to kiss her on the lips. Her friend came in and told him to leave, which he did.”

A group of men including Morgan and Ukaegbu, known as Prince, went into the bedroom. Morgan kept trying to get the girl to sit on his lap.

She kept trying to get away from him, said Mr Connolly. He kept pulling her back. She sat on the floor because she didn’t want to be next to him.

A friend put her back on the bed and she fell asleep.

“The next thing she remembers is waking up and finding Mr Morgan on top of her,” said Mr Connolly. “She was on her back. He was kissing her.

“Her skirt had been lifted up to her waist. She could also see Mr Ukaegbu by the door. He appears to have been watching.

“He was shouting to him to keep the door shut and if anyone came to let him know. The next thing she was aware of was the bedroom door opening and her friend coming into the bedroom.

“Mr Morgan Immediately got off her and started pulling up his trousers. She was escorted out of the bedroom and the police were called.”

Morgan sprinted down the stairs and out of the house, followed by Ukaegbu.

After his arrest, Morgan claimed the teenager was awake and consented to sex.
