GILLINGHAM will appeal against Adam Miller's sending off in the 3-1 win at Huddersfield on Saturday.
Miller received his marching orders from referee David Foster following a last minute challenge on Frank Sinclair.
But after reviewing the video of the incident manager Mark Stimson feels they have grounds to appeal to the Football Association.
Stimson said: "It seems harsh. Adam's sole intent was to win the ball. He's not a malicious player and I think the reaction of the Huddersfield players told its own story."
If the club succeeds he will avoid a three-match ban but the FA could extend it if they feel the appeal is unwarranted.
Miller was back in the side on Saturday after returning from a one match ban having picked up five yellow cards this season.
