A drink-driving dad has been banned from the road after crashing his BMW into two parked cars with his young family in tow.
Tomas Bogdan “lost control” of his vehicle and struck a van and a Mini Cooper in Ferndale Road, Gillingham, in the early hours of August 23 last year.
Video footage presented in court during his sentencing hearing shows a young child getting out of the back seat of the car and running away in distress just moments after.
The 34-year-old’s partner can also be seen exiting the damaged vehicle after the smash as paramedics and police arrive and arrest him.
Bogdan, of Lindon Road, Gillingham, was later charged with drink-driving and admitted the offence in February when he appeared in court and was handed an interim driving ban.
At the time, a pre-sentencing report was ordered to be carried out on him and he returned to Margate Magistrates’ Court to be sentenced on March 4 when the bench heard it was not the first time he’d been caught driving while over the legal limit.
Lucie Fish, prosecuting, said the incident happened at 3.39am in Ferndale Road when the BMW “lost control” and struck two parked cars.
She added: “Paramedics attended and they were assisted into an ambulance and the police suspected he was intoxicated and he failed a breath test and was arrested.”
However, the prosecutor also told the court Bogdon was taken to hospital to get checked over at about 4.15am and then later was taken into custody at Medway Police Station in Purser Way, Gillingham.
Ms Fish added: “He then gave a breath test reading of 60 microgrammes and that was at 8.44am so it was some time after [the crash].”
She then showed magistrates footage from the scene which showed the car had ended up colliding with a Mini Cooper.
A young child is seen exiting his car from the rear passenger seats in some distress.
The prosecutor added: “He has previous for driving while over the drug drive limit and it was less than 10 years ago, so he needed to be banned from driving for a minimum of three years.”
If someone is convicted of drink or drug driving twice within 10 years, the law states they face a minimum of three years of driving disqualification and can be jailed for up to six months for the offence.
Ms Fish added: “He was also convicted of driving with excess alcohol in 2011 and so has a history of disregarding the law when it comes to driving and there were passengers in the vehicle and it was a left-hand drive.”
The prosecutor then showed images of the damage to the van and the Mini Bogdan had hit in his BMW.
Gemma Winson, defending, told the court Bogdan accepted full responsibility for his actions and admitted his offence was aggravated by the fact he had previous similar convictions, that there were passengers in the car and that he had a crash.
She added: “He was in the wrong and he accepts he was responsible.
“He couldn’t sleep [properly] for two or three weeks as he was so ashamed and if he has to wear an alcohol monitoring tag, that will not be a problem.
“He was socially drinking and he’s not working.”
Magistrates told Bogdan because he had a history of disregarding court decisions they were placing him on a 15-month community order which would see him complete 150 hours of unpaid work.
He was also ordered to wear an alcohol abstinence tag for 90 days and attend 15 rehabilitation sessions.
The dad was also banned from driving for 40 months which he was told started from the date he was given the interim ban in February.
Bogdan was also ordered to pay a victim surcharge of £114, as well as £85 court costs.
