FINES totalling £178,500 have been imposed for the breach of health and safety rules over the death of a building worker at the Fremlin Walk shopping development in Maidstone four years ago.

The bulk of the amount - £100,000 - will be paid by the main sub-contractors, P J Carey Ltd. Miller Construction (UK) Ltd was fined £75,000.

Site supervisor Sean Mongan will have to pay £2,500 and Barry Pollen, the unqualified driver of a dumper truck that killed father-of-two Justin Taylor, £1,000.

Miller, P J Carey, Mongan, 49, of Co Donegal, Southern Ireland, and homeless Pollen, 59, all admitted failing to comply with a duty imposed by the Health and Safety at Work Act of 1974.

Miller, the principal contractor on the site, also admitted a second charge of failing to comply with a Health and Safety regulation.

Mr Taylor, 29, of Melford Drive, Barming, Maidstone, was struck by the six tonne dumper truck on June 20 2003, three months after work started on the £100million development.

In addition to the fines, Miller was ordered to pay £52,227 costs and P J Carey £17,643.
