A woman was left sobbing after she woke to discover a man she had met just hours earlier at a Halloween party raping her, a court heard.

She and a friend had accepted a lift home to Herne Bay from two men they met at the Source Bar in Maidstone on October 28 last year.

But Maidstone Crown Court heard they ended up at a one-bedroom flat in Rainham after the driver, introduced to them earlier in the evening as "Julian Pearce" and referred to as JP, decided he was too tired to take them home.

Prosecutor Danny Moore said the two women initially made calls to taxi companies but did not have enough money for the £140 fare they were being quoted.

They then decided to stay because it was too early in the morning - 5am - to call anyone they knew to pick them up.

"That woke up her friend and she quickly followed her into the bathroom. She said that her friend was sobbing and crying and very upset..." - Danny Moore, prosecuting

They got into the bed together, to be joined by the second man, Wayne.

However, Mr Moore said that when Wayne's attempts to "try it on" with the other woman were rebuffed, he simply fell asleep.

It was then that "Julian" - real name Brian Maddix - climbed into bed behind the second woman. The jury was told he was wearing "boxer shorts at least".

She fell asleep, the court heard, with the two women in the middle and the men on each side.

When she woke up an hour later the defendant was having sex with her, the court heard.

Mr Moore continued: "That woke up her friend and she quickly followed her into the bathroom. She said that her friend was sobbing and crying and very upset."

The jury heard the two women left the flat and returned to Herne Bay by train.

The alleged victim met up with her "on-off" boyfriend and was said to have "immediately broken down" and told him what happened.

The incident was reported to police a week later after the woman had spoken to a counsellor.

Maddix, 25, of King Street, Gillingham, was traced through the car he had driven that night and arrested on November 27. He denies rape.

He told police that once at the flat the woman had tried to get a taxi because she was worried she would be in trouble with her mum for not going home.

However, he added that she had been "flirty" with him. "He said he took that as an indication of what might happen, as he put it," explained Mr Moore.

Maddix also said that within a few minutes of him getting into the bed, she had started to rub her bottom against his genitals.

"He said he was drifting off to sleep but took that as an indication that there should be some further sexual contact," added Mr Moore.

When asked by police why he stopped and the woman ran off, Maddix said cannabis he had smoked at the flat and the three neat brandies he had drunk were "sloshing around in his stomach" and he felt sick.

Maddix added that the woman got out of bed about 15 minutes later, followed by her friend after another 15 minutes, and then they left.

He said he offered them a lift but they declined.

The prosecutor told the jury at the start of the trial they would have to decide why Maddix had adopted the identity of Julian Pearce.
