Alleged rape victim describes waking up with ex-Gillingham football player Nathan Nyafli on top of her after sleeping with Bradley Dack in Maidstone

A woman has told how she was in a deep sleep after having sex with a professional footballer - and woke up to find one of his former teammates on top of her.

The 22-year-old woman said she eventually managed to push off ex-Gillingham striker Nathan Nyafli, 21, and then fled after declaring she had been raped.

Maidstone Crown Court has heard she and a friend had been out in the town drinking on May 7 last year and ended up at the Source Bar.

The alleged victim said in a recorded interview she had been talking to an Italian man she thought was good looking but did not speak English in the nightclub, and she joked with her friend about "an Italian stallion".

In a reference to Gills player Bradley Dack, 21, she said his teammate Michael Freiter, 19, told her: "You need an Italian stallion like my friend".

After getting some food they went to a flat where the players were staying, and she had sex with Mr Dack.

"We were both naked," she continued. "No contraception was used. Once we finished having sex I rolled over. I was absolutely knackered. I always put the duvet between my legs.

"I fell asleep. I can fall asleep like that. There is not much that can wake me up. He went downstairs. I woke up. I originally thought it was Bradley.

"When I properly came round it wasn't Bradley. I had my knees on my shoulders. I was on my back. He was having sex with me. I had never seen him before.

"It was literally a matter of seconds. He didn't say anything. Bradley was in the corner of the room masturbating. I told him (Nyafli) to get off.

"I said: 'It's not right. What are you doing?' He didn’t say anything. He just carried on. It was quite aggressive. I had a bruise on my arm where he gripped me. He was big and heavy.

"Bradley wasn't wearing anything. He didn't say anything. I pushed this guy off me and jumped out of bed. I said: 'I am leaving'.

"I pretty much forced him off me. I got out of bed and went into the hallway. My friend said she would get a taxi. I screamed at her: 'Don’t leave this house without me'.

"I woke up. I originally thought it was Bradley. When I properly came round it wasn't Bradley... He was having sex with me. I had never seen him before..." - alleged victim

"I went back into the bedroom and picked up my clothes. They kept saying: 'Where you going?' I said: 'This is not right'. The guy was still in bed.

"I went downstairs. My friend said: 'What's wrong?' I basically said: 'I have just woken up to some guy s------- me.'"

She said she told Mr Freiter: "One of your friends has been s------- me while I was asleep." They called a taxi and left.

Giving evidence from behind screens, the woman agreed CCTV showed her and Nyafli talking, dancing and kissing in the club.

She accepted she was wrong when she told police she had not seen him before.

Simon Taylor, defending, suggested a different scenario to the one she had described at the flat.

"After you had sex with Mr Dack the defendant came into the room and spoke to you. He asked you whether you had been with Mr Dack. He kissed you. You said words of encouragement to him."

Mr Taylor suggested Nyafli had touched her intimately and she told him to have intercourse with her.

She wept as she denied all the suggestions. She also denied it was possible she uttered some words of encouragement, mistakenly thinking it was Mr Dack.

Asked by prosecutor John O'Higgins if she consented to sex with Nyafli, she replied: "No". Asked if she discussed with Nyafli going back to the flat to have sex, she said: "No, I was with Bradley."

The other woman said in evidence that after they arrived at the flat, her friend went upstairs with Mr Dack.

She was later sitting on a sofa downstairs when Mr Dack came down and she saw he was completely naked. "I was a bit freaked," she said.

She shouted out to her friend she had booked a taxi.

The woman continued: "She started screaming: 'Don't leave without me'. She came running down the stairs. I said: 'What's the matter?' She said: 'This is not right'.

"I asked her what happened. She said: 'I have been raped. This is really weird. I want to leave. Get me out of here.' She was crying and shaking.

"She said she went to sleep and some fella was on top of her. I was angry. I ran upstairs. I saw Nathan lying on the bed. I said: 'What are you doing?'

"Michael was concerned. I said: 'Your friend has just raped her.' I said I was going to call the police. She was very upset."

Questioned by Simon Taylor, defending, she said she had asked Nyafli: “What the ----- going on?" She added: "I may have said: 'This is disgusting'. I shouted at him.

"I said: 'What the ---- have you just done?' He said: 'She was telling me to give it to her harder.'

"I said: 'No, she didn't. She wouldn't be in that state if she had'."

Gills player Michael Freiter said he and Bradley Dack met up with Nyafli and Tetteh Johnson and went into Maidstone shortly before midnight.

"We went to the Source Bar," he said. "It was a good evening. We just chilled out really. We talked to two women. We were all getting along.

"Bradley and Nathan joined in. She and Bradley were talking and kissing."

After leaving the club they went to get some food. He, Mr Dack and the two women then went to the flat. Mr Dack and one of the women went upstairs to a bedroom.

"It didn't come as any surprise to me," he said. He and the other woman went to another bedroom.

He heard the buzzer to the front door and Mr Dack went down to answer it. He worked out that it was Nyafli and Mr Johnson arriving.

"I wasn't sure where Nathan was but I thought he had gone upstairs," he said. "I think Bradley went upstairs."

Mr Freiter, 19, said he called a taxi for the woman he was with after she said she wanted to go. The other woman came downstairs.

"She was expressing that she would like to leave," he said. "She was a bit flustered. I said: 'Why do you want to leave?' She wouldn't tell me."

He agreed that he had said in a police statement that the woman was "in a stressed state" and in a panic.

"She kept saying she wanted to go home," said Mr Freiter. "She desperately wanted to leave."

The prosecutor said Bradley Dack would not be a witness at the trial. "You should not speculate on what he might say if he were," he told the jury of eight men and four women.

Nyafli, of Tollgate Way, Maidstone, denies rape. The trial continues.
