A 22-year-old man has been charged with causing death by dangerous driving after a fatal crash on the M2.
Connor Money, of Essex Road, Dartford, remains in custody and is due to appear before Medway Magistrates' Court today.
It comes after the BMW estate he was driving crashed into the back of a lorry near Medway services after failing to stop for police.
An air ambulance was called to the scene and paramedics and fire crews worked tirelessly but were unable to save the car passenger, who was aged in his 20s.
The identity of the man has yet to be revealed.
Tuesday's crash, between Junction 3 for Chatham and Junction 5 for Sittingbourne, happened at around 1.35pm.
It led to part of the M2 being closed for more than eight and a half hours while police investigated, resulting in large parts of Kent coming to a standstill.
Meanwhile, the actions of officers leading up to the fatal crash will now be examined by the Independent Office for Police Conduct.
A police spokesman today confirmed: "A mandatory referral has been made to the Independent Office for Police Conduct due to the vehicle failing to stop for police several minutes prior to the incident."
