Man denies raping girl under a table in a bar

A young woman alleged to have been raped under a table at a Maidstone bar has told a court she remembered very little of what happened.

The teenager said she had no recollection of Ersin Bicimli having sex with her at the Chicago Rock Cafe at a Christmas party last year.

But a work colleague told Maidstone Crown Court she came out of the toilets and saw a man on top of the woman having sex with her.

Turkish born Bicimli, of Pearse Place, Lamberhurst, denies rape, claiming what happened was consensual.

The woman said she drank one Southern Comfort and Coke before sitting down for a meal. She had three glasses of wine and another Southern Comfort and Coke.

She went onto the dance floor and noticed a man looking at her and friends. “I felt uncomfortable,” she said. “I didn’t say anything to him.”

After getting her last drink from the bar, she put it on the table.

“I don’t remember anything after that,” she told the jury. “I don’t remember anything happening to me in the club. I don’t remember seeing the man again.

“I don’t remember how I came to leave the club or how I got home. “

When she arrived at work the next morning her manager asked if she remembered anything from the previous night.

“Apparently, there was a witness who saw a man getting off me,” she said. “I said I didn’t remember. I felt quite shocked.”

The police were called and she gave a statement and was medically examined.

When asked what she could remember, she said she could recall feeling happy.

She agreed she got drunk easily, but denied the alcohol went to her head that evening and loosened her inhibitions.

She denied sending signals back to Bicimli she was attracted to him and denied having consensual sex with him. .

Her work colleague told the court a man had been constantly looking over at their table and tried to dance in their group.

She said she could see no sign of interest from the alleged victim.

“I went to the toilets,” she said. “I came out and something caught my eye under the table. I saw a lady lying on her back and a man on top.”

She realised it was the alleged victim.

“She didn’t seem to be taking part in the act of intercourse,” said the woman.

One of the other women in the party asked the man: “What’s going on?” The man pulled his trousers up and walked off.

The colleague said the alleged victim had “a vacant expression” and didn’t seem aware of what had happened.

“I wasn’t really able to get any sense out of her. Before that, she had been enjoying herself. She was up dancing, she was laughing. She didn’t look at all drunk when I last saw her.”

The witness and another woman went to the bar to confront the man . He shrugged his shoulders and put his hands up. The other woman slapped him around the face.

He was escorted out of the bar and the alleged victim was put in a cab and sent home.
