A Medway couple who were found liable for an accident on a bouncy castle which left a boy with brain damage, have won their appeal.

Sam Harris, 13, who was a party in Strood, suffered a broken skull when a older boy kicked his head in 2005.

Sam whose family have since moved to Spalding, Lincolnshire, now needs round-the-clock care.

In May Sam was awarded more than £1m damages when a judge ruled that Timothy and Catherine Perry, had not provided enough supervision for the party on a field behind their home in Jersey Road, Strood.

But on Thursday, their lawyers successfully argued the pair were the same as “parents up and down the land.”

The High Court was told the accident happened during the seconds that Mrs Perry had gone to help another child on another inflatable.

But her lawyers said the judge had applied the wrong test to the conduct of Mrs Perry.
